Who we are: The NumberPlates.Auction website is owned and operated by NPA (also referred to in this document as "we", "us", "our" and "NPA"). We are a company registered in BC, Canada. You can also contact us by email at info@NumberPlates.Auction.

What this document is: You may make a copy of this document for reference. This document is called the "Terms". It is: A legally binding agreement between any user of our services (whether online or offline) (called a "User" or "you") and us. It is the legal rules that govern our relationship; and is accepted by you if you use our website or use any of our services (including Escrow and our Internet social networking pages and channels). If you do not agree to the Terms, then you may not use our website or services.

Version of the Terms: This version of the Terms went live on 16 October 2017. We may update these Terms from time to time at our discretion by displaying changed terms on this website. However, the version of these Terms that is current when you visit this website or use of any of our services, will apply whenever you use this website or our services.

What we do: We provide a service for private individuals or companies to buy/sell vehicle Number plate Number Plate /slogans/ marks (called "Number Plate s" in this document).
Note: When we use the word "own" to mean ownership of Number Plate , we mean the person who has primary rights at the time, subject to government authorisation.

Governing law and jurisdiction: Canadian law shall apply to these Terms and to any dispute which may arise out of, under, or in connection with these Terms or services we provide. You irrevocably agree that the Canadian courts will have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or any of our services.

The NPA Auction Service

Our auction service: We operate an auction service (called the "NPA Auction") which is open to people registered on our website. The service is available only for registered numbers which have previously been submitted by a seller for valuation. This Section 9 applies to that service.

Operation of our auction service: By listing a Number Plate in the NPA Auction, the seller is authorising us to advertise that Number Plate for sale. The advertised price of the Number Plate will be based on the reserve price, if specified. If no reserve price is specified, the valuation the seller was given by us will be used as the basis for the advertised price unless the seller contacts us to specify a price. After the auction is over, if the Number Plate  is unsold, the user can continue to advertise the Number Plate  for sale by reposting the Auction only up to 7 times.

How long auctions run for: Auctions run for a maximum 90 days from commencement.

Price: Sellers specify a starting price and a reserve price. Sellers are contractually bound to sell the Number Plate if the reserve price has been met. We cannot be held liable for any auction sales which complete with a low sale price, where an insufficient reserve price has been specified.

'Buy it Now': a seller can also specify a 'Buy It Now' price, and is contractually bound to sell at this price if a bidder wishes to purchase the Number Plate immediately without the delay and uncertainty of the auction process, the buyer will be transferred to our 'Secure Order Form' to complete the purchase and paragraphs 2 and 3 of these Terms will then apply to the purchase.

Rules for bidders: Bidders using the NPA Auction must comply with the following rules:

A bidder bidding on a Number Plate is contractually committed to buying that Number Plate on winning the auction. Bids may only be retractable in exceptional circumstances at our exclusive discretion (e.g. if a Seller has misrepresented a Number Plate or does not have any legal rights to a Number Plate).

 

What is the cost of selling my Number Plate(s) on NPA?

 

To Publish an Ad/Auction with NPA it will cost you as follows

Standard Package £100

Includes NPA FB Page Post with over 70,000 followers and NPA Instagram Post

All Ads/Auctions will run until the Number Plate is sold. 

Premium Package £150

Includes NPA FB Page Post with over 70,000 followers, NPA Instagram Post, an Ad/Auction on the NPA Front Page and a Free Number Plate Valuation worth £50

All Ads/Auctions will run until the Number Plate is sold. 

No Commission is charged to the seller after a successful auction Bid or Ad listing 

 

Cost of buying a Number Plate from NPA:

The only fee which the buyer will need to pay is 50% of the Escrow fee, if the buyer is successful with an Auction bid or Ad.  

Registering an account with NPA:

In order to Buy or Sell on the NPA platform (publish an Auction, Ad listing, bid etc) you will need to register an account with us. Registering with NPA allows us to confirm your identity.

Selling Number Plates from any country in the World:

We provide this service for over 100 countries in the world. If you find you country is not listed please contact us.

The currencies NPA supports:

Currently we support USD, EUR and GBP

Number Plates limits you can I sell on NPA:

At this time there is no limit on how many Number Plates you can sell on NPA

For a bidder winning an auction:

You will have the following Payment options after a Successful Auction bid or Ad listing:

PayPal - (for transactions less than $750 USD, £750 or 750 EUR)

The buyer will contact the seller with his details for the transfer documents and will then pay the seller in full. Buyer will then wait for the transfer documents to arrive.

Credit Card - (for transactions less than $750 USD, £750 or 750 EUR)

The buyer will contact the seller with his details for the transfer documents and will then pay the seller in full. Buyer will then wait for the transfer documents to arrive.

NPA does not take any commission from PayPal or Credit Card transactions as those transactions are less than $750 USD, £750 or 750 EUR.

Escrow – Please refer to the Escrow section below (for transactions over $750 USD, £750 or 750 EUR).

 

When buying or Selling a Number Plate via Escrow:

 

Buyer, Seller and NumberPlates.Auction agree to terms – 

NumberPlates.Auction begins a three-party transaction. After all parties are registered at Escrow.com, all parties agree to the terms of the transaction.

Buyer pays Escrow.com – 

Buyer submits a payment by selecting wire transfer, Escrow.com verifies the payment, and then NumberPlates.Auction and Seller are notified that funds have been secured

Seller sends the signed Number Plate Transfer Documents to Buyer – 

Upon payment verification, Seller is authorised to send Number Plate Transfer Documents. Escrow.com verifies that the Buyer receives the Number Plate Transfer Documents. NumberPlates.Auction is notified.

Buyer accepts Number Plate Transfer Documents – 

The Buyer has a set number of days (30 days) to inspect and send the Number Plate Transfer Documents to the their Government’s Vehicle Licensing Department and the option to accept or reject it. The Buyer accepts the Number Plate Transfer Documents.

Escrow.com pays NumberPlates.Auction and Seller - Escrow.com releases the funds to the Seller.

 

Buyers Fee’s when using Escrow:

The buyer will pay 50% of the Escrow fee, which is normally between 1 – 3% of the purchase price of the Number Plate.

For Example: Purchase price is $10,000, Escrow Fee is 2% ($200). Buyer will pay 50% of that Escrow Fee ($100)

Sellers Fee’s when using Escrow:

The seller will pay 50% of the Escrow fee, which is normally between 1 – 3% of the purchase price of the Number Plate.

For Example: Purchase price is $10,000, Escrow Fee is 2% ($200). Seller will pay 50% of that Escrow Fee ($100)

The Seller will also pay a Commission to NumberPlates.Auction. Please contact us for the current Commission rate.

 

Refunds from the Escrow service:

US Dollar Transactions

In the event of a cancelled transaction or a partial refund to the Buyer, the Buyer's funds will be refunded back to the original source of the payment method used to pay Escrow.com. Escrow.com charges fees to refund via wire transfer - $10 for domestic wires, $20 for international wires. The original escrow fee is also non-refundable.

Euro Transactions

Funds will be wired back to the Buyer. The Buyer will need to enter wire details in their customer profile. Euro refunds will not be charged a wire fee. The escrow fee is non-refundable.

The bidder will be required to supply suitable vehicle documents for the Number Plate to be assigned onto.

Where Number Plate(s) owned by NPA as stock numbers are offered for sale in auction, the purchaser will have the choice of having the Number Plate transferred to a vehicle immediately or of having the Number Plate supplied on certificate for transfer to a vehicle at a later date.

The conditional nature of the winning bid is the same as that for purchasing

There is a 'transfer fee' payable on top of a winning auction bid by the new owner. This is set out on our Fee’s and prices section in the FAQ page.

Tax will often be payable on top of any bid price. If so, this will be clearly displayed at each stage of the auction.

For any Number Plate in an auction, the current location of that Number Plate will (where specified by the owner) be displayed on the first bidding page. If the Number Plate is currently on a Certificate. Bidders should take note of this information as the Certificate may need to be extended soon after winning an auction.

If a bidder selects to be alerted these alerts will be sent when the bidder is outbid on an auction or when an auction is ending soon and the bidder is not currently the winning bidder.

Rules for sellers: Sellers using the NPA Auction must comply with the following rules:

A seller entering a Number Plate  into an auction/Ad warrants that the Number Plate  is transferable, i.e. that:

It is on a valid Certificate or on a vehicle which is fully taxed and tested;

The seller has legal rights to the Number Plate ;

If the Number Plate is on a Certificate which needs to be extended as part of the transfer process, that the seller may have to pay an extension fee.

By listing a Number Plate for sale using the NPA Auction, the seller agrees to pay the relevant listing and selling fees as detailed in the FAQ  web page.

The first time a listing fee is payable, the seller will be asked to pay via PayPal.

All listing fees are non-refundable and are payable in USD.

Once a seller's reserve price has been reached on a Number Plate, that seller may not bid on that Number Plate (or authorise or procure anyone else to do so). If no reserve price has been entered for a Number Plate, the seller may not bid (or authorise or procure anyone else to bid) on that Number Plate at all.

 

General rules: The following general rules apply to the NPA Auction service:

All participants in an auction accept that we are not responsible or liable for:

The failure of sellers or buyers to provide required documentation;

Verification that the conditions for successful transfer have been met, and/or for the consequences of failure to have those conditions met.

We may withdraw a Number Plate from auction at any time and for any reason. (For example, we may do this if we discover that a Number Plate has been misrepresented or the seller does not have any legal rights to the Number Plate.)

Indemnity: Each participant in an auction on the NPA Auction service hereby agrees to indemnify us against all damages, costs, charges, losses, liabilities and expenses incurred by us arising from or connected to the consequences of that participant's failure to comply with any of the rules.

 

Publications

How we display number plates: Sometimes, we and/or our websites and/or other publications may publish or display images showing number plates that do not conform to current legal standards. This will only occur when the image features a vehicle that actually bears a plate, or plates, that do not conform to current legal standards. In such cases, we simply depict the reality of how the plate is being displayed. We do not promote or condone the display of non-regulation number plates, and we actively advise against it.

 

No endorsement: We are not affiliated to any Government and we do not take any part in the policing and enforcement of the current legal standards for display of number plates in any way. Accordingly, we do not censor of images that may show failure on the part of the authorities to enforce those regulations. However, if we accept an image submitted for publication by someone else that depicts non-regulation number plates that are not an endorsement of any kind by us of the display of such illegal number plates.

 

Submissions of contributions by you: When you submit any contribution (be it text, photographs, graphics, video, audio or otherwise) to us, either expressly for publication or as part of a competition entry or otherwise, you agree, by the act of sending your material, to the following conditions:

You grant to us a non-exclusive, perpetual, royalty-free right and licence to use, reproduce, modify, adapt, publish, distribute and create derivative works from your contribution. If you do not want to grant us free use of what you send, then we request that you do not contribute items to us;

By submitting your contribution to us, you warrant that your contribution:

Is your own original work and/or that you have the legal right to make it available to us for the purposes of our business;

Is not defamatory; and

Does not infringe any law or any person's rights..

You hereby indemnify us against from and against all claims, liabilities, proceedings, costs, damages, losses, or expenses incurred by us caused by, or in any way connected with, your breach of any applicable law.


These Terms

Indemnity: You shall indemnify us against all damages, costs, charges, losses, liabilities and expenses incurred by us arising from or connected to your breach of any of these Terms.

Events outside our control: If and to the extent that we are prevented or delayed by any event outside of our reasonable control (e.g. delays or errors caused by the postal system, email, the Department of Transport) from performing any of our obligations under these Terms or otherwise, we shall be relieved of liability for failure to perform or for delay in performing such obligations (as the case may be) but only as directly resulting from that event outside of our reasonable control.

Whole agreement: These Terms contain all the terms agreed between you and us and they supersede and exclude any prior agreement, understanding or arrangement between you and us, whether oral or in writing. No representation, undertaking or promise shall be taken to have been given or be implied from anything said or written in negotiations between you and us which contradicts or otherwise cuts across these Terms except as expressly stated in these Terms. No person shall have any remedy in respect of any untrue statement made by us upon which that person relied in entering into any contract with us incorporating any of these Terms (unless such untrue statement was made fraudulently) and that person's only remedies shall be for breach of contract as provided in these Terms.

Severability: Should a court decide that any part of these Terms is invalid and/or cannot be enforced, that particular element of these Terms will not apply, but the rest of these Terms will remain in force.

No waiver: No waiver by us of any violation or default in performance of the provisions of any of these Terms by any person shall be deemed a waiver of such provisions or of our right to later enforce such provisions.

Survival: Those provisions of the Terms that either are expressed to survive their termination, or from their nature or context it is contemplated that they are to survive such termination, shall survive termination of the Terms.

Telephone calls: Calls may be monitored for training and to provide evidence in the case of dispute.

In these Terms:

The headings to clauses of these Terms (and summary words at the start of each clause) are for convenience and reference only and do not form a part of these Terms and shall not in any way affect the interpretation.

References to the singular includes the plural and vice versa; and any gender includes all other genders (as applicable);

References to "include" and "including" shall be deemed to mean respectively "include(s) without limitation" and "including without limitation" and

References to "person" or "persons" shall include partnerships, bodies corporate and unincorporated associations of persons and vice versa. (including, for the avoidance of doubt, persons, individuals, companies, firms, governments, states, regional or local authorities, agencies of a state, joint ventures, trusts, charities, societies, funds, associations (whether or not having separate legal personality and whether incorporated or not)).
